Experda (“Experda”, “we”, “us” or “our”) provides the following information concerning its collection, storage and use of personal data (“Personal Data” or “Personal Information”) provided by visitors and shoppers at www.Experda.com (the “Site”).

Experda respects the privacy of all persons who visit or use the Site (“Customers” or “you” or “Data Subjects”).  Experda also protects the privacy of its employees, vendors, service providers, partners and others who come in contact with the Site.  The Site is intended for use by Customers in the United States and the principal aim of this Privacy Policy is compliance with the privacy and data protection laws of the United States including the California Consumer Privacy Act of 2016 (“CCPA”) and the California Consumer Privacy Rights Act of 2018 (“CPRA”). It also contains references to EU’s General Data Protection Regulation (“GDPR”) under the terms of which Experda may be considered the “data controller.”

This policy and notice (“Privacy Policy”) explains the types of data we may collect from you or that may be provided when you visit the Site.  Other websites offered by Experda’s affiliates, suppliers, and business partners – even if accessed through this Site – are subject to their own privacy and data protection policies.  

Please read the following carefully to understand our practices regarding your personal data and how we will treat it.  Experda intends to be transparent about its practices regarding the information it collects, stores, uses, maintains, and processes, and describes its current practices in this Privacy Policy.

INFORMATION THAT WE COLLECT

Summary: Experda collects Personal Data about you from your transactions with us, like using the Site, visiting us at conferences, calling our call center, making a purchase or entering an agreement with us.

 Experda collects non-identifiable, anonymous information (“Non-Personal Data”).

 Experda also might collect several categories of personal data (“Personal Data”).  Personal Data we may collect consists of any personal data provided by you, or by an organization you represent or are associated with or through your use of the Site. This may include your first and last names, email address, phone numbers, picture, postal address, birthdate, gender, credit card and other such payment and billing details, billing address, login credentials, your account username and password, usage details, and similar information for your organization, together with other information you may choose to provide to Experda.

 Additionally, we may obtain location data for the geographic location of your laptop, mobile device, or other digital device used to access the Site.

Experda may also collect the email addresses of people who communicate with Experda via email or other social media platforms, or who create accounts and log-in credentials. Experda may also collect information about people who call our call center, including information that enables us to identify the caller and follow up on the call, as well as any information provided during the call, including a voice recording of the call.

By registering on the Site, downloading our software solutions, or submitting support or information requests via the Site, Experda will collect your name, company name, phone number, personal or company email address, and other information. Experda may use this information to offer Experda’s services and support and will share this data across Experda group companies and affiliates to optimize its services.

You do not have any legal obligation to provide any information to Experda; however, we require certain information in order to perform services requested on the Site, such as the sale or purchase of “Products” or to provide any services. If you choose not to provide us with certain information, we may not be able to provide you with some or all the services or fulfil your order for “Products.”

You may create an Experda account on our software solutions. In some cases, you may be able to access Experda services through login credentials of a designated third-party website or service (each a “Third Party Account”), including but not limited to Google, LinkedIn, Facebook, or Twitter. Doing so will enable you to link your Experda account and your third-party account. If you choose this option, then you will be required to approve the connection as well as the provision of information (which may include Personal Information, such as your profile picture, gender, headline, summary, friends’ lists, previous positions, and organizations) that we may obtain from your Third-Party Account. Any data submitted to any Third-Party Account, even on and through the Site, is managed directly by such third party and is not the responsibility of Experda.

 Additional third-party services may be accessed through the Site. Experda is not responsible for any personal data or other data submitted to, or otherwise processed through, such third-party services. For example, where a credit card purchase is made on the Site, customers may be redirected to a third-party service provider to submit payment, and all aspects of that service and payment, including any Personal Data submitted in connection with that service, are within the responsibility of the third-party service provider, and not of Experda.

Experda also collects contact and related data about potential customers via the Site, at events, through social media (such as Facebook and LinkedIn), from our professionals when it is provided for that purpose, and through other such sources. This data is used to market our products and keep our followers up to date on Experda. We store this data with third-party providers of marketing data processing (for example, Hubspot), including in the USA and elsewhere.

HOW DO WE COLLECT YOUR PERSONAL DATA?

Summary: Experda collects Personal Data through your use of our Site, through data you or others provide when you prepare and enter a contract with us, or otherwise engage with us, or contact us.

 

In other words, when you use the Site, we are aware of it and may gather, collect, and record information about such usage, either independently or through third-party services, as detailed below. This may include technical information and behavioral information such as the User’s Internet protocol (IP) address used to connect your computer to the Internet, your uniform resource locators (URL), operating system, type of browser, browser plug-in types and versions, screen resolution, Flash version, time zone setting, the User’s ‘clickstream’ on the Site, the period of time the User visited the Site, methods used to browse away from a page, and any phone number used to call our customer service number. We likewise may place cookies on your browsing devices (see ‘Cookies’ section below).

We collect Personal Data required to provide services when you register interest, place an order, and/or open an account. In addition, we collect your Personal Data when you provide it to us by entering it manually or automatically, through your use of our Site, facilities, services, and applications, or in connection with site visits, in the course of preparing a contract, or otherwise in engaging with us. We also collect Personal Data through our CCTV recordings, call center facilities, and card reader and visitor registration systems, which automatically record information about your presence in our facilities.

 

WHAT ARE THE PURPOSES OF PERSONAL DATA WE COLLECT?

Summary: Experda uses Personal Data for a range of lawful purposes, such as: staying in touch, improving our services, meeting our obligations, providing support.

 

We will use Personal Data to provide and improve our services and products and meet our contractual, ethical, and legal obligations, including, but not limited to, the following:

  • to enable us to meet our legal, contractual, ethical, and business obligations as an employer and a potential employer for our employees and job applicants.
  • carrying out our obligations arising from any contracts entered into between you or your employer or organization and Experda and/or any contracts entered into with Experda, and to provide you with the information, products, and services that you request from Experda.
  • administering your account with Experda, including identifying and authenticating you.
  • verifying and carrying out financial transactions in relation to payments you make in connection with the products.
  • notifying you about changes to our service and products.
  • contacting you for the purpose of providing you with technical assistance and other related information about the products.
  • replying to your queries, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity.
  • contacting you to give you commercial and marketing information about events or promotions or additional services and products offered by Experda, including in other locations.
  • soliciting feedback in connection with your use of the services and the products purchased.
  • tracking use of Experda facilities and services to enable us to optimize them.
  • contacting you to inform you of additional services and products which may be of interest to you.
  • compliance and audit purposes, such as meeting our reporting obligations in our various jurisdictions, and for crime prevention and prosecution so far as it relates to our staff, customers, facilities etc.
  • if necessary, we will use Personal Data to enforce our terms, policies, and legal agreements, to comply with court orders and warrants, and assist law enforcement agencies as required by law, to collect debts, to prevent fraud, infringements, identity thefts, and any other service misuse, and to take any action in any legal dispute and proceeding.
  • for security purposes and to identify and authenticate your access to the parts of the facilities.

 

SHARING DATA WITH THIRD PARTIES

Summary: Experda shares data with its affiliates and partners, as well as our suppliers, vendors, and service providers.

 

We may share Personal Data with:

— Affiliates, suppliers, vendors, and service providers (our “Group”): This includes any member of our Group in the US and elsewhere.

 

— Third Parties. We share Personal Data with third parties in various circumstances. We take steps to ensure that these third parties use your information only to the extent necessary to perform their functions, that they provide the same level of protection of your rights as we do, and that they have a contract in place with us to govern their processing on our behalf. These third parties may include business partners, suppliers, affiliates, agents and/or sub-contractors for the performance of any contract we enter into with you. They assist us in providing the products we offer, processing transactions, fulfilling requests for information, receiving and sending communications, analyzing data, providing IT and other support services or in other tasks, from time to time. These third parties may also include analytics and search engine providers who assist us in improving and optimizing our Site, our application, and our marketing.

We periodically add and remove third-party providers. At present, our third-party providers to whom we may transfer Personal Data include the following: Website analytics; computing providers; customer ticketing and support; on-site and cloud-based database services; vendor and IT service and support providers; distributors, shipping and logistics companies; our lawyers, accountants, and other standard business services.

In addition, we may disclose your Personal Data to third parties: if some or all of the Experda companies or assets are acquired by a third party including by way of a merger, share acquisition, asset purchase or any similar transaction, in which case Personal Data may be one of the transferred assets.

We may transfer Personal Data to third parties if we are under a duty to disclose or share your Personal Data in order to comply with any legal or audit or compliance obligation, in the course of any legal or regulatory proceeding or investigation, or in order to enforce or apply our terms and other agreements with you or with a third party; or to assert or protect the rights, property, or safety of Experda, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction and to prevent cybercrime.

For avoidance of doubt, Experda may transfer and disclose Non-Personal Data to third parties at its own discretion.

WHERE DO WE STORE YOUR DATA?

Summary: Experda stores your Personal Data securely at its facilities or with its service providers. 

We may keep Personal Data in servers and systems owned or controlled by Experda in our various sites, or processed by third parties on behalf of Experda, by reputable cloud-service providers and other such service providers, including in Experda Group locations in the United States and Israel and the European Economic Area. Data is also stored in our onsite and offsite backups.

INTERNATIONAL DATA TRANSFERS

Summary: Personal Data may be transferred between Experda locations and other Group locations, and where applicable the necessary safeguards will be implemented.

 

Personal Data may be transferred to, and stored and used at, a destination outside the EU that may not be subject to equivalent data protection laws to those of the EU. Where your Personal Data is transferred outside of the EU, we will take all steps necessary to ensure that your Personal Data is subject to appropriate safeguards, and that it is treated securely and in substantive accordance with this Privacy Policy. Experda transfers data, including Personal Data, to and from the locations and jurisdictions of the Group to other jurisdictions as follows:

  • To and from the United States of America and additional non-EU locations. Transfer to the US and elsewhere is done subject to Standard Contractual Clauses, or some other mechanism valid under GDPR; and
  • To and from Israel. Members of Experda’s Group are located in Israel. Israel is considered by the European Commission to offer an adequate level of protection for the Personal Information of EU Member State residents; we may transfer data to other countries with an adequacy ruling, too; and
  • Within the EU.

We may transfer your Personal Data to and from the EEA in order to:

  • Store or back up the information.
  • Enable us to provide you with the services and products and fulfil our contract with you.
  • Fulfill any legal, audit, ethical, or compliance obligations that require us to make that transfer.
  • Facilitate the operation of our group businesses, where it is in our legitimate interests, and we have concluded these are not overridden by your rights.
  • To serve our customers across multiple jurisdictions.
  • To operate our parent company, subsidiaries, and affiliates in an efficient and optimal manner.

DATA RETENTION

Summary: Experda does not to retain your Personal Data once it no longer serves the purposes for which we collected it.

 

Experda will retain Personal Data it processes only for as long as reasonably required to provide the services, to comply with our legal and other obligations, to resolve disputes, to enforce agreements, and generally to meet the purposes for which it was collected. We will also retain Personal Data to meet audit, compliance, and business best-practice requirements. The retention period will vary based on the form and purpose of the data, and the jurisdictions involved.

Personal Data that is no longer retained may be anonymized or deleted. Likewise, some metadata and statistical information concerning the use of our services are not subject to the deletion procedures in this policy and may be retained by Experda. We will not be able to identify you with this data. Some data may also be retained on our third-party service providers’ servers until it is deleted, in accordance with their privacy and retention policies. Even when we delete data, some Personal Data may remain in our backups and various systems until they are cycled out or until it is feasible to remove that data.

SITE AND APPLICATION DATA COLLECTION AND COOKIES

Summary: The Site places and tracks cookies, and collects some data, such as IP addresses. You can control this and stop it through your web browser.

 

Details of the cookies being used on our site are available on the cookie management tool on our site. Those details will be updated from time to time.

Most browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you block or erase cookies your online experience on our Site will be limited.

How to disable cookies: the effect of disabling cookies depends on which cookies you disable, but, in general, the Site and some services delivered through it may not operate properly, may not recognize your device, may not remember your preferences, and so on, if cookies are disabled or removed. However, you can choose to allow or disable cookies. If you want to disable cookies on our site, you can do so by clicking ‘reject all’ in the cookie management tool on our site, or by rejecting the cookies by category. Our Sites may, from time to time, contain links to external sites. We are not responsible for the operation, privacy policies, practices, or content of such sites.

OPTIONAL COOKIES

Cookies that are optional and not essential to site functionality have the options to be switched (on/off) or to accept recommended settings.

 

SECURITY AND STORAGE OF INFORMATION

Summary: we store personal data securely, but there is no such thing as perfect data security.

 

Experda takes great care in implementing, enforcing, and maintaining the security of the Personal Data we process. Experda implements, enforces, and maintains security measures, technologies, and policies to prevent unauthorized or accidental access to or destruction, loss, modification, use, or disclosure of Personal Data. We likewise take steps to monitor compliance with such policies on an ongoing basis. Where we deem it necessary, considering the nature of the data in question and the risks to data subjects, we may encrypt data. As noted above, we also endeavor to delete Personal Data that no longer serves its purpose. Likewise, we take industry-standard steps to ensure our Sites and applications are safe.

Note, however, that no data security measures are perfect or impenetrable, and we cannot guarantee that unauthorized access, leaks, viruses, and other data security breaches will never occur.

Within Experda, we endeavor to limit access to Personal Data to those of our personnel who: (i) require access in order for Experda to fulfil its obligations under law and contract, and under this Privacy Policy, and (ii) have been appropriately and periodically trained on the requirements applicable to the processing, care and handling of the Personal Data, and (iii) are under confidentiality obligations as may be required under applicable law.

Experda will act in accordance with its policies and with applicable law to promptly notify, where so required, the relevant authorities and data subjects in the event that any Personal Data processed by Experda is lost, stolen, or where there has been any unauthorized access to it, all in accordance with applicable law and on the instructions of a qualified authority.

RIGHTS FOR CALIFORNIA RESIDENTS UNDER THE CCPA & CPRA

We value your privacy. Under the CCPA and CPRA, you have the right to opt out of the “sale” or “sharing” of your personal information. While we don’t sell data for profit, we do use Google Analytics to help improve our services. If you’d prefer, we do not share your data for this purpose; you can update your preferences via our Cookie Management Tool on our website or reach out to us directly at dpo@experda.com. CCPA may permit you to request in writing a list of the categories of personally identifiable information disclosed by Experda to third parties, and the identities of those third parties, during the preceding year, for the third parties’ direct marketing purposes, and to obtain such information free of charge up to twice in a 12-month period.

CCPA also may grant you the right to request disclosure from Experda of the following:

  1. The categories of Personal Information Experda has collected information about you.
  2. The categories of sources from which Personal Information is collected.
  3. The business or commercial purpose for collecting Personal Information.
  4. The categories of third parties with whom the business shares Personal Information; and
  5. The specific pieces of Personal Information Experda has collected about you.

In addition, you may have various rights in relation to your Personal Information:

  • a right to request that we rectify your Personal Information if our records are inaccurate;
  • a right to request that we delete your Personal Information;
  • a right that we provide you with your Personal Information in a readily accessible format;
  • a right to request that we limit the use of your sensitive Personal Information.

There is no cost to making a request to exercise any of your rights. However, Experda may require that you verify your identity.

Where a California resident consumer has exercised any of the consumer’s rights, Experda will not discriminate against the consumer for exercising such right, including, but not limited to, by not doing any of the following:

  1. Denying goods or services to the consumer.
  2. Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
  3. Providing a different level or quality of goods or services to the consumer.
  4. Suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services.

 

DATA SUBJECT RIGHTS

Summary: You may have various rights regarding your Personal Data.

 

Data subjects with respect to whose data the GDPR applies have rights under the GDPR and local laws, including, in different circumstances, rights to data portability, access to data, rectification of data, object to processing, and erasure of data. Where a request for erasure is made, some Personal Data may remain in our backups and various systems until they are cycled out or until it is feasible to remove that data. Where processing occurs based on consent, data subjects may have the right to withdraw their consent, which will not affect the lawfulness of processing that occurred prior to the withdrawal.

If, for any reason, a data subject wishes to modify, delete, or retrieve their Personal Data, they may be able to do so by contacting Experda and its data protection officer at dpo@experda.com. Note that Experda may have to undertake a process to identify a data subject exercising their rights. Experda may keep details of such rights exercised for its own compliance and audit requirements. Please note that Personal Data may be either deleted or retained in an aggregated manner without being linked to any identifiers or Personal Data, depending on technical and commercial capability. Such information may continue to be used by Experda.

Data subjects in the EU have the right to lodge a complaint with a data protection supervisory authority. If the supervisory authority fails to deal with a complaint, you may have the right to an effective judicial remedy.

GENERAL

 Minors. We do not knowingly collect or solicit information or data from children under the age of 16 or knowingly allow children under the age of 16 to register for Experda services. If you are under 16, do not register or attempt to register for any of Experda’s services or send any information about yourself to us. If we learn that we have collected or have been sent Personal Data from a child under the age of 16, we will delete that Personal Data as soon as reasonably practicable without any liability to Experda. If you believe that we may have collected or received information from a minor under the age of 16, please contact us at  dpo@experda.com as soon as possible.

Changes to this Privacy Policy. The terms of this Privacy Policy will govern the use of our services, Websites and activities, and any information collected in connection with them. Experda may amend or update this Privacy Policy from time to time. The most current version of this Privacy Policy will be available at: https://www.experda.com/privacy-policy. Changes to this Privacy Policy are effective as of the stated “Last Revised” date, and your continued use of our services and Sites indicates your active acceptance of our Privacy Policy. Our policies and practices are constantly evolving and improving, and we invite any suggestions for improvements, questions or comments concerning this, Policy. You are welcome to contact us, and we will make an effort to reply within a reasonable timeframe.
